need help with Trust

Postby RogueHK on Wed Feb 03, 2010 7:31 pm

Ok first off I want to say I've been in contact with David Goldman

I asked Mr.Goldman if I can live in IL and open a trust in WI even if I'm not a resident of WI. He said this is doable but I haven't received any other communication with him so I'm asking anyone here if they know how I would start this?

You can form an out of state trust and keep NFA firearms in a state different than your primary residence

I honestly don't know. I would call the ATF and ask them as that's your best bet. I wouldn't take anyone elses word for it, if the ATF stays it's ok and you get it in writing, you're covered.

I wouldn't do it, even if they say you can, unless they put it in writing. They could reel you in on that anytime they ever wanted to. It might stick. It might not. Either way your life would be SOL.

If you are going out of state go Corporate. A corporation is a pure legal entity and can own things. Normally I'd advise an LLC over a corporation but in this instance, I'd even be leery of an L.L.C. unless a managing member lives in the State in question and has control over the guns.

Now before an internet lawyer jumps all over me and claims an L.L.C. is fine and demands that I prove otherwise.... you are right in that I can not prove otherwise. But there is a fine line between proof and paranoia and when dealing with the ATF I would err on the side of paranoia.

Floating a pure trust out there like that is just asking for trouble.

I wouldn't' deal with Wisconsin at this time. We currently are under the (hopefully soon to be ended) dictatorship of an anti firearms democrat, and his seat is the target of one that is even worse. Further, I wouldn't trust the BATFE's word, even if you have it in writing, UNLESS they can and WILL supply you with chapter, paragraph and line quotes of the regulations granting said "permission". We have seen way too many examples of someone higher up the the line of "authority" rescinding the interpretation of a subordinate.

FYI I am aware this is in ressponse to a months old post...
